1. Introduction and Acceptance

Welcome to Blackseed Asia Pte Ltd ("Blackseed Asia", "we", "us", or "our"). By accessing our website, using our online tools (including calculators), or engaging our engineering services, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all visitors, users, and others who access or use our services ("Service").

2. Engineering Supply Services

Blackseed Asia provides specialised fire suppression equipment and components. Our supply terms are as follows:

• Product Specification: All equipment is supplied according to the agreed technical specifications. It is the client's responsibility to verify that these specifications meet their project's unique requirements unless a rigorous design consultation has been formally engaged.
• Delivery and Inspection: Risk of loss or damage to goods passes to the client upon delivery. Clients must inspect all goods immediately upon receipt and notify Blackseed Asia of any discrepancies or defects within 3 business days.
• Warranty: Equipment is warranted against manufacturing defects for a standard period of 12 months from the date of supply, subject to proper storage and handling by the client.

3. Testing and Commissioning Services

Our commissioning services verify that installed systems operate according to design parameters.

• Site Readiness: The client must ensure the site is ready for testing at the agreed time. "Ready" includes safe access, completed mechanical/electrical installation, and the availability of necessary power and communication links. Delays caused by site unpreparedness may incur additional charges.
• Scope of Testing: Commissioning includes functional testing of discharge valves, pressure switches, notification appliances, and detection logic. It does not include full discharge tests unless explicitly specified in the contract.
• Handover: Upon successful commissioning, a handover certificate will be issued. The system is deemed accepted by the client upon the signing of this certificate.

4. Online Communications and Digital Services

Blackseed Asia leverages digital tools to enhance customer service and information accuracy.

• Response Time: We aim to acknowledge all digital enquiries (email, contact forms) within 24 hours. Technical queries may require longer for detailed engineering review.
• Calculators and Tools: Online calculators (e.g., for FM-200 or Novec 1230 agent quantity) are for estimation purposes only. They do not constitute a certified engineering design. Final quantities MUST be verified by a qualified engineer using approved hydraulic calculation software.
• Information Sharing: Technical datasheets, manuals, and drawings shared via our portal or email are proprietary or licensed material. They are provided solely for the operation and maintenance of the specific project for which they were requested.

5. Intellectual Property

The content, features, and functionality of our website and services, including but not limited to text, graphics, logos, and software code, are the exclusive property of Blackseed Asia Pte Ltd and are protected by international copyright, trademark, and other intellectual property laws.

6. Limitation of Liability

In no event shall Blackseed Asia Pte Ltd, its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; or (iii) unauthorised access, use, or alteration of your transmissions or content.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
